Terms and Conditions<\/h1>\n

Please read these Terms and Conditions before using the e-shop www.lensexpress.ee. You should understand that by ordering optical appliances from the Lensexpress.ee website, you enter into a legally binding contract with Helinet Grupp O\u00dc which you agree will be governed by these Terms and Conditions. If you do not agree to be bound by these Terms and Conditions you must refrain from using or ordering products from the Lensexpress.ee website.<\/p>\n

1. GENERAL<\/strong>
\n1.1. The website Lensexpress.ee is owned and operated by HELINET GRUPP O\u00dc (referred to in these Terms and Conditions as Seller). HELINET GRUPP O\u00dc is a company registered in Estonia under the company number 12173504. The company\u00b4s address is: Sarapuu 82, Tabasalu, Harku vald 76901, Estonia.<\/p>\n

1.2. Seller sells and the Buyer purchases goods offered by the Seller through the e-store according to the submitted order. Order is reversed to execution after money has income to the account number of the Seller.<\/p>\n

1.3. All prices in Lensexpress.ee are in EUR, VAT included.<\/p>\n

1.4. The Seller has the right to unilaterally change the prices and selection of goods without any obligation to inform the Buyer of this. If the Seller has changed the prices after the Buyer has already submitted an order, the Seller is obligated to deliver the goods at the prices displayed at the time of sale.<\/p>\n

1.5. Displayed product pictures have an illustrative meaning and may differ from the real product. Product descriptions in Lensexpress.ee are not complete and may contain unwanted mistakes.<\/p>\n

2. THE BUYER CONFIRMS THAT:<\/strong>
\n2.1. They have a prescription for contact lenses or glasses issued by an optometrist or eye doctor and they are aware how to use and maintain contact lenses and other optical appliances.<\/p>\n

2.2. They are aware of the dangers that may accompany wearing contact lenses.<\/p>\n

2.3. They have submitted correct personal data (first name, family name, contact phone number, e-mail address, delivery address, postal code).<\/p>\n

2.4. After submitting an order, they will pay for the goods and delivery to the Seller’s bank account by bank transfer, credit or debit card. If the Buyer is taking an obligation to pay by invoice, an obligation is taken then to pay during three (3) days starting from the day order has been made.<\/p>\n

3. THE SELLER CONFIRMS THAT:<\/strong>
\n3.1. All the contact lenses, cleaning solutions, glasses and sunglasses available in the e-store are original products and correspond to the order submitted by the Buyer.<\/p>\n

3.2. The Seller will begin fulfilling the order after receiving the Buyer’s payment to the Seller’s bank account, after which the order will be fulfilled within 1-30 days. The delivery time of each product has been marked to the products\u00b4 description. As the Seller does not partially ship orders the time required to dispatch the order will be based on the product with the longest dispatch time.<\/p>\n

3.3. The goods will be delivered to the Buyer according to the selected means of delivery.<\/p>\n

3.4. If for some reason it is not possible to fulfil the order, the Seller will contact the Buyer immediately and they will agree to an equal product replacement or other compromise.<\/p>\n

4. GUARANTEE AND RETURNS<\/strong>
\n4.1. The Seller must be informed of any complaints regarding the products immediately after detecting the defect by e-mail info@lensexpress.ee. The defects of contact lenses must be apparent upon their first use. Any claims regarding glasses or sunglasses shall be submitted to the Seller immediately after detecting the defect. The right to submit a claim shall be valid for two (2) years from the date of delivery of the products to the Buyer. During the first twelve (12) months of this period, it shall be assumed that the defect existed at the time of delivery of the products. It is the Seller’s responsibility to rebut this assumption.<\/p>\n

4.2. Upon presenting a complaint, the Buyer will forward the products package, copy of the order and the problem’s clarification to the Seller at the address: Helinet Grupp O\u00dc, Sarapuu 82, Tabasalu, Harku vald, Harjumaa, Estonia 76901.<\/p>\n

4.3. Provided that the product in mentions proves defective, the Seller will send the Buyer a replacement product or a discount code in the value of the defective product, which can be used for future purchases. Delivery charges will not be compensated.<\/p>\n

4.4. If the product does not prove to be defective, the Seller is not obligated to replace the product. Such an instance will be regarded as a violation of the use and maintenance rules of the products.<\/p>\n

4.5. The Buyer has the right to withdraw from the contract within 14 days of receiving the goods and have their purchase refunded. The Buyer must inform the Seller of their wish to withdraw from the contract in advance via the return form<\/a> or by e-mail info@lensexpress.ee. The returned products must be in their original packages and untainted.<\/p>\n

4.6. If the Buyer ordered the Goods to Estonia using an Omniva, SmartPOST or DPD Pickup parcel machine, the Goods can be returned free of charge using the same delivery method. If the Buyer ordered the Goods to Estonia using SmartKuller, the Goods can be returned free of charge via SmartPost parcel machines. In other cases and when ordering the Goods abroad, the Buyer shall bear the costs associated with returning the Goods.<\/p>\n

4.7. Products that are not subject to return: plus power lenses, multifocal, toric and coloured lenses, plus power swimming goggles and glasses that are made according to the Buyer\u00b4s prescription. It is not possible to return lens containers, travel kits and tweezers for hygienic reasons.<\/p>\n

4.8. Upon returning the goods, the Seller is obligated to refund the purchase at latest within seven (7) days of returning the goods. Refunds will be limited to the maximum value of the original order and will only be issued against the same credit card or bank account as supplied to pay for the goods. The Seller reserves the right to proportionately reduce the level of the refund if only some of the original quantity of contact lenses is returned, or if it is clear that some of the products have been used.<\/p>\n

4.9. If The Buyer desires withdraw from the contract after the order has been placed and before shipping of the goods, the Buyer is obliged to inform the Seller immediately by e-mail info@lensexpress.ee. E-mail has to include the date, the order had been placed, number of the order, contact data of the Buyer (first name, family name, contact phone number). When application for withdrawal reaches the Seller after shipping the goods, then withdrawal is taking place according to points no 4.5 – 4.8.<\/p>\n

5. CONFIDENTIALITY AND PRIVACY<\/strong>
\n5.1. The personal data entered when submitting the purchase will be entered into the Seller’s database and will only be used for fulfilling the order and offering goods. By entering the data, the Buyer gives the Seller permission to process their data. The protection of personal data is guaranteed with security measures.<\/p>\n

5.2. The Seller commits to not forwarding the Buyer’s data to third parties, excl. the data necessary to the postal company for providing the postal service.<\/p>\n

5.3. The Sellers online payments are managed by Montonio. The Buyers credit card detailes are entered directly to Montonio\u00b4s secure site. The payment service complies with PCI DSS (Payment Card Industry Data Security Standard) security standards.<\/p>\n

6. FINAL PROVISIONS<\/strong>
\n6.1. The Seller has the right to change the Terms and Conditions of use unilaterally and without prior notice. Amendments and additions to the Conditions of use become valid from the time they are posted on the web page.<\/p>\n

6.2. The legal relations between the Seller and Buyer are subject to the legislation valid in the Republic of Estonia.<\/p>\n

6.3. Any disputes arising from this agreement will be solved by means of negotiation. Provided that negotiations prove unsuccessful, the dispute will be solved by the Consumer Protection Board (The Online Dispute Resolution\u00a0website<\/a>) or Harju County Court.<\/p>\n","protected":false},"excerpt":{"rendered":"
